Terms and Conditions

1. Acceptance of Terms

By accessing or using the Sweetgrass platform and services, you agree to be bound by these Terms and Conditions. If you do not agree to these terms, you may not use our services.

2. Fractional Ownership Structure

Sweetgrass offers fractional ownership interests in luxury residential properties through a limited liability company (LLC) structure. Each property is held by a separate property-specific LLC.

  • Ownership interests are typically offered in 1/8 shares
  • Each share represents a percentage ownership in the property-specific LLC
  • Owners receive a membership interest in the LLC, not direct title to the property
  • All ownership documentation is recorded and maintained in accordance with applicable state laws

3. Property Usage Rights

Your fractional ownership share entitles you to exclusive use of the property according to the following terms:

  • 1/8 share ownership provides 6 weeks of annual usage (up to 46 weeks for additional shares)
  • Usage is scheduled through our proprietary scheduling system
  • Peak seasons and holidays rotate annually among owners
  • Reservations can be made up to 12 months in advance
  • Unused weeks may be rented through our rental program (subject to availability)

4. Financial Obligations

4.1 Purchase Price

  • Initial deposit of $10,000 (fully refundable before construction begins)
  • Full payment required before construction commencement
  • Financing available through approved lending partners

4.2 Monthly Fees

  • Monthly HOA dues ranging from $600 to $1,200 per share
  • Covers property management, maintenance, insurance, and property taxes
  • Reserve fund contributions for major repairs and replacements
  • Fees are subject to annual adjustment based on actual costs

5. Property Management

Sweetgrass provides comprehensive property management services including:

  • Professional cleaning between stays
  • Regular maintenance and repairs
  • Landscaping and pool maintenance
  • Utility management
  • Concierge services
  • 24/7 owner support

6. Resale and Exit Rights

Owners may sell their fractional interest subject to the following conditions:

  • Right of first refusal to other existing owners
  • Sales through Sweetgrass marketplace or independently
  • 3% transfer fee on resales
  • All transfers subject to LLC operating agreement provisions
  • Buyer must be approved by property management

7. Construction and Development

For pre-construction properties:

  • Owners participate in design decisions through voting
  • Construction progress updates provided monthly
  • Estimated completion dates are subject to change
  • 10-year builder warranty on all new construction
  • Full refund available if construction is cancelled before commencement

8. Prohibited Activities

The following activities are strictly prohibited:

  • Subletting without approval
  • Commercial use of the property
  • Modifications to the property without consent
  • Exceeding maximum occupancy limits
  • Illegal activities
  • Pets without prior approval
  • Smoking inside the property

9. Liability and Insurance

Sweetgrass maintains comprehensive insurance coverage including:

  • Property insurance for full replacement value
  • General liability insurance
  • Directors and officers insurance
  • Owners are encouraged to obtain personal liability insurance

10. Dispute Resolution

Any disputes arising from these terms or your ownership shall be resolved through binding arbitration in accordance with the American Arbitration Association rules. The arbitration shall be conducted in Texas, and Texas law shall govern these terms.

11. Amendments

Sweetgrass reserves the right to modify these terms with 30 days notice to owners. Material changes require approval by a majority of owners in accordance with the LLC operating agreement.

This document constitutes the entire agreement between you and Sweetgrass regarding the use of our services. By purchasing a fractional interest, you acknowledge that you have read, understood, and agree to these terms.
